Cravath’s New York Office Moves to Two Manhattan West
Gary A. Bornstein is Co-Head of the Litigation Department. He handles a wide range of high‑stakes commercial disputes, with particular focus on antitrust, M&A and securities litigation. Mr. Bornstein also represents clients in investigations and frequently provides antitrust, fiduciary duty and other transaction-related advice.
Named a Competition MVP by Law360, Mr. Bornstein has extensive experience in complex antitrust litigation. He served as lead trial counsel for Epic Games, creator of the hugely popular game Fortnite, in two high‑profile antitrust actions against Google and Apple alleging anticompetitive behavior in the distribution of mobile apps and the handling of in‑app payments. After a multiweek trial in the case against Google, Mr. Bornstein obtained a unanimous jury verdict in favor of Epic on all counts. In connection with this victory, he was recognized as The Am Law Litigation Daily’s “Litigator of the Week.” Following a three‑week bench trial in the Apple case, Mr. Bornstein secured a nationwide permanent injunction against Apple’s anti‑steering policies. On October 7, 2024, the U.S. District Court for the Northern District of California entered a post‑trial order in favor of Cravath client Epic Games imposing a nationwide three‑year permanent injunction against Google. The injunction, which follows Epic’s jury trial win against Google last year, prohibits Google from paying competitors not to compete and requires Google to distribute alternative app stores on the Google Play Store and provide alternative app stores with access to the Google Play Store’s catalog of apps.

Originally brought in 2017 on behalf of an alleged nationwide class of mobile device purchaser plaintiffs, the multi-district litigation consolidated numerous complaints against Qualcomm and followed a related Federal Trade Commission action against the company (FTC v. Qualcomm), which also resulted in a complete judgment for Qualcomm on appeal in 2020.

The 2025 edition of Benchmark Litigation named Cravath partners Daniel Slifkin, David R. Marriott, Gary A. Bornstein and Kevin J. Orsini to its list of the “Top 100 Trial Lawyers,” which consists of “partners who have been venerated by peers and clients as being the best in breed at the nuanced practice of trial law.” This is the fifth year in which Daniel and Kevin have been recognized, the fourth year in which Gary has been named to the list, and the second year in which David has been recognized.

Gary A. Bornstein was named to The Hollywood Reporter’s “New York Power Lawyers” list, which recognizes the “25 most powerful entertainment lawyers in New York” and was published in the September 19, 2024 issue of The Hollywood Reporter Magazine. The feature highlighted Gary’s representation of Epic Games in its successful antitrust litigation against Google and of a Special Committee of Paramount Global’s independent directors in connection with litigation matters related to the company’s pending $28 billion merger with Skydance.

On September 5, 2024, Cravath was named the recipient of the New York Law Journal’s 2024 “Litigation Department of the Year” award in the General Litigation category, the publication’s highest firmwide honor for litigation practice. The Firm was honored at the New York Legal Awards for a period that saw it earn numerous major successes on behalf of clients across industries, including Epic Games in an antitrust trial victory against Google, Robinhood in the sprawling and high-profile “meme stock” litigation and PG&E in its successful defense against a putative class action involving wins in multiple courts.

On August 29, 2024, the New York Law Journal published a Q&A with Cravath partners Gary A. Bornstein and Kevin J. Orsini in connection with the Firm’s recognition as a 2024 Litigation Department of the Year finalist. In the Q&A, Gary and Kevin discussed the Firm’s work for clients in the last year, including representing Epic Games in its antitrust litigation challenging core aspects of Google’s app store policies; a string of successes for Robinhood in its “meme stock” litigation; and a victory for PG&E before the California Supreme Court related to power shutoffs to prevent wildfires.
