Cravath’s New York Office Moves to Two Manhattan West

Benjamin J. Bauer focuses on antitrust litigation and merger clearance matters.
Mr. Bauer is a seasoned antitrust lawyer and has experience representing multinational clients across all phases of the merger review process in the United States and globally—from preliminary risk assessment through litigation in federal court. In addition, Mr. Bauer has represented corporate and individual clients in a wide range of antitrust conduct investigations and related proceedings, including cartel defense and follow-on civil litigation.
Before joining Cravath, Mr. Bauer worked at global law firms in Washington, D.C. and New York. Mr. Bauer started his legal career at the Federal Trade Commission’s (FTC) Bureau of Competition, first as an Honors Paralegal, and later as a Legal Intern in the Mergers I Division.
Mr. Bauer currently serves as a Vice Chair of the Compliance and Ethics Committee of the American Bar Association’s Antitrust Law Section.
Mr. Bauer was born in Schenectady, New York. He received a B.A. magna cum laude from Union College in 2008, where he was elected to Phi Beta Kappa, and a J.D. from Georgetown University Law Center in 2013. After graduating from law school, Mr. Bauer served as a law clerk to Judge Sally D. Adkins of the Supreme Court of Maryland.

On Monday, April 15, 2024, the U.S. Court of Appeals for the Second Circuit affirmed the U.S. District Court for the Southern District of New York’s granting of summary judgment in favor of Cravath client Mylan in a securities class action related to Mylan’s marketing, pricing and classification of EpiPen as well as alleged conduct concerning generic drug price fixing and market allocation.

Cravath represented Amgen, one of the world’s largest biopharmaceutical companies, in successfully defending against a Federal Trade Commission (“FTC”) challenge to Amgen’s pending $27.8 billion acquisition of Horizon Therapeutics (“Horizon”)—securing a consent order on September 1, 2023 that The Wall Street Journal described as “a rare instance” of the FTC “throwing in the towel on litigation.”
