Cravath’s New York Office Moves to Two Manhattan West
On February 5, 2020, retired Cravath litigation partner Rory O. Millson presented the International Arbitration Club of New York’s (IACNY’s) ninth annual Smit‑Lowenfeld Prize for best article in the field of international arbitration. The award was to given to Soterios Loizou for his article entitled “Revisiting the ‘Content‑of‑Laws’ Enquiry in International Arbitration,” which was published in the Louisiana Law Review (Vol. 78, No. 3).
Rory serves as chair of IACNY’s selection committee for the award, which honors the late professors Hans Smit, former Stanley H. Fuld Professor Emeritus at Columbia Law School, and Andreas Lowenfeld, former Rubin Professor Emeritus at the New York University School of Law, for their distinguished careers in the field of international arbitration, both as scholars and as arbitrators.
Mr. Loizou’s winning article provides a multi‑level analysis of the “content-of-laws” enquiry by examining the establishment of the content of applicable law in international litigation and arbitration from legal theory, using a comparison of various legal regimes to highlight the emerging trend toward the use of the “facultative” jura novit arbiter standard in international arbitration proceedings and providing a model and outlining a method for arbitral tribunals and national courts when reviewing arbitral awards in annulment proceedings.
