Cravath’s New York Office Moves to Two Manhattan West

On February 5, 2024, The Am Law Litigation Daily interviewed Cravath partner David R. Marriot in connection with his representation of photographers Donald Graham and Eric McNatt in winning judgments against appropriation artist Richard Prince and his co defendants Laurence Gagosian, Gagosian Gallery and Blum & Poe gallery, in a case at the intersection of art, technology and copyright law.
In the interview, Dave spoke about the significance of the victory, which “affirms a bunch of important ideas: There’s no celebrity plagiarist privilege. You don’t have a different set of fair use rules that apply to you if you happen to be famous and successful than if you’re more of a working artist or an unfamous artist.”
Dave addressed the nature of the judgments against Prince which “got all that we could have reasonably expected to get in a trial,” as well as the importance of the case in demonstrating that the internet “is not a copyright free‑for‑all…There are protections there to ultimately benefit people in ways that promote the kind of incentive system that actually gave rise to some of the technology behind the internet in the first place.”
