Cravath’s New York Office Moves to Two Manhattan West
On February 28, 2022, Cravath partner David R. Marriott was featured in a Q&A published by Leaders League. He discussed several of the notable matters the Firm’s complex trial team worked on in 2021, and the preparation that goes into handling multiple trials each year across a wide range of practice areas and industries. Dave also spoke about the capabilities of Cravath’s Investigations and Regulatory Enforcement group and how it is evolving to meet clients’ cyber‑related concerns.

January 19, 2021
On January 19, 2021, the New York Appellate Division, First Department, affirmed the complete dismissal of claims against Cravath client Goldman Sachs (“Goldman”) by the New York State Supreme Court’s Commercial Division in May 2020. Those claims by Goldman’s former client, United Natural Foods, Inc. (“UNFI”), alleged breach of contract and fraud relating to Goldman’s handling of the syndication of a term loan that UNFI used to finance its $3 billion acquisition of SuperValu Inc. UNFI sought to recover damages in excess of $230 million, representing recoupment of fees paid and other costs of syndication, as well as incremental interest costs it expects to pay over the life of the loan.

On September 29, 2021, the United States Court of Appeals for the Ninth Circuit ruled in favor of Cravath client Qualcomm Incorporated (“Qualcomm”), vacating a class certification order in Stromberg v. Qualcomm, a class action suit that is related to a prior antitrust suit brought against Qualcomm by the Federal Trade Commission (“FTC”), FTC v. Qualcomm. The Stromberg plaintiffs brought antitrust claims against Qualcomm, and the formerly certified class included an estimated 250 million members in the U.S.
