On March 31, 2014, Cravath partner Lauren A. Moskowitz was quoted in an article in The Huffington Post entitled “No Equitable Tolling in Hague Abduction Convention.” Lauren represented Ms. Montoya Alvarez pro bono in the U.S. Supreme Court case Lozano v. Alvarez, an international custody dispute. In the article, Lauren commended the Court’s decision to deny equitable tolling of the one-year period for filing a petition for a child’s return before the “now settled” defense can be asserted under the Hague Convention on the Civil Aspects of International Child Abduction. The Court ruled unanimously in favor of Ms. Montoya Alvarez, protecting the best interests of her child and making new law by clarifying this aspect of the Hague Convention.
