On February 18, 2019, Cravath partner David J. Kappos co‑authored a paper, in conjunction with Slaughter and May and The Center for Global Enterprise, on the impact of Europe’s General Data Protection Regulation (GDPR) on blockchain implementations, providing a roadmap for how blockchains can be brought into compliance with various GDPR strictures. The paper unpacks four “guiding principles” for GDPR‑compliant blockchains: Use a private, permissioned blockchain; avoid, if possible, the storing of personal data on the blockchain; establish a detailed governance framework; and employ innovative solutions to data protection problems.
